Have You Been Mis-Advised About QROPS?

Were you been misadvised about QROPs? If so, we may be able to assist you claim compensation.

What Are QROPS?

QROPS (Qualifying Recognised Overseas Pension Schemes) were introduced in 2006. They are a type of pension that exists outside the UK, but which receives its funds from a pension fund within the UK.

QROPS pensions proved popular because, depending on the tax arrangements at the QROPS’ location, they could help you lower your tax burden.

QROPS were always subject to rules set by HMRC, but recently a number of the schemes have been closed down, either because they failed to comply with HMRC’s rules, or because they were being used to exploit tax loopholes.

Is My QROPS Scheme Secure?

Possibly not. Schemes that fail to follow the rules will be (or have been) declared unlawful. And with opposition growing to high profile tax avoidance schemes such as QROPS, even those schemes currently on HMRC’s ‘accepted’ list may not remain accepted. A change of legislation could render any scheme unlawful.

If your QROPS pension is declared in breach of legislation, any transfers you make to it will be treated as ‘unauthorised’. The penalties could be severe:

  • Unauthorised transfers will be taxed at 55%
  • The heavy commissions you pay to your QROPS management company or fund manager will effectively be for nothing
  • By transferring funds out of your UK pension, you will have lost the benefits of that fund, whilst incurring penalties with the new one

Can I Claim QROPS Compensation?

Like all forms of pension mis-selling, if you have suffered financial loss, there are a number of ways you could demonstrate that you were mis-sold or mis-advised:

  • Your personal circumstances were not properly considered at the time
  • You were not told about the risks of QROPS
  • You were advised to transfer your entire pension savings into QROPS
  • You were advised that transferring your pension was necessary

Tax avoidance, evasion and you

Tax is complex. Over the years, the complexity has grown, and that has meant that people looking to pay less tax may have been able to exploit perfectly legal ‘loopholes’. There’s nothing wrong with this form of tax avoidance, although it will almost certainly take your accountant, financial advisor or investment fund manager to identify these opportunities for you.

But not every loophole is legal. Illegally avoiding tax is known as tax evasion.

Wrongly advised on tax – can I claim?

HMRC is the organisation that interprets legislation and determines whether the tax mitigation schemes you are a part of are legal. If your scheme is declared illegal, you’ll be required to pay a penalty which could, depending on the amount of tax you’ve avoided, run into many thousands. Claim Experts may be able to help you claim money back if the following apply:

  • You were advised to place money into a pension, investment fund or similar to reduce your tax liability
  • The scheme has now been declared illegal
  • You’ve received a demand from HMRC requiring you to pay tax and/or a penalty as a result of being part of the scheme
  • Your accountant or financial advisor didn’t make you aware of the risks of investing in the tax saving scheme
  • You feel you were misled about the tax mitigation scheme, or misadvised about its benefits, or its appropriateness for you.

If the above apply to you, you could be entitled to compensation for the mis-advising or mis-selling of your tax mitigation scheme. Call Claim Experts now on DETAILS.
